How it Works

Document Preparation

Prior to the mediation, parties will submit briefs and related documents for review. A LYNC staff will schedule a pre-mediation call with each party separately to discuss the case, establish trust, and share perspectives.

What to Expect on Mediation Day

During the opening session, the mediator introduces the purpose and process of mediation and establishes the ground rules and expectations for the day. As a third-party neutral, the mediator’s role is to facilitate the negotiation and ensure that these joint sessions and private caucuses are confidential.

Formalizing the Process

Parties will execute a mediation agreement prior to the mediation session to formalize the process and set the terms for how a dispute will be discussed. A mediation agreement is NOT a settlement agreement. If a settlement is reached, the mediator concludes with a summary of the resolution in a binding contract, signed by all relevant parties.
